These Terms of Service govern your use of westchasepainting.com and the painting services provided by Westchase Painting Company LLC, operating as Noble Tampa LLC ("Westchase Painting", "we", "us", or "our"). By requesting an estimate, signing a proposal, or otherwise engaging us, you agree to these terms. If you do not agree, please do not use our services.
Free Estimates
Estimates are free, no-obligation, and based on the scope of work observed during the site visit or described by you. Verbal estimates are for discussion only. Only written estimates signed by an authorized representative of Westchase Painting are binding.
Estimate Validity
Written estimates are valid for 30 days from the date issued. After 30 days, material costs, labor availability, and scheduling may change, and we may need to re-quote the project. Prices are subject to change if the scope of work expands, if hidden conditions are uncovered (wood rot, mold, structural repairs), or if materials chosen differ from those originally specified.
Deposit and Payment Terms
- A deposit (typically 30-50% of the total contract) is required to reserve your project start date. Specific deposit amounts are listed on each written proposal.
- Progress payments may be required on projects over $10,000.
- Final balance is due on the day of project completion, after walkthrough and your approval.
- We accept check, ACH, major credit cards (a processing fee may apply), and financing through Acorn Finance.
- Invoices not paid within 15 days of project completion may incur a 1.5% per month late fee to the extent permitted by Florida law.
Scheduling and Weather Delays
We schedule exterior work around Florida weather. Rain, excessive humidity, high winds, and temperatures outside the manufacturer's application range may require us to pause or reschedule work without penalty. We will communicate delays as soon as we can and reschedule at the earliest possible date.
Cancellation Policy
- More than 7 days before start date: Cancel at no cost. Any deposit paid is fully refundable within 10 business days.
- 3-7 days before start date: Your deposit is refundable minus any materials already ordered or custom-tinted paint that cannot be returned.
- Less than 3 days before start date: Deposit is non-refundable due to committed crew scheduling, unless we can redirect the crew to another project.
- After work has started: You will be billed for all work completed to that point, plus any materials used or already opened, plus a reasonable administrative fee.

Customer Responsibilities
- Provide safe access to the work area and to water and electricity as needed.
- Move or protect valuable, fragile, or irreplaceable items from work areas. We will move standard furniture and protect flooring.
- Secure pets during work hours.
- Disclose known conditions (lead paint, asbestos, prior water damage, pest issues) before work begins.
- Obtain HOA color approvals in advance. We are happy to supply samples or specification documents but final HOA sign-off is the homeowner's responsibility.
Warranty
All workmanship is covered by our written Limited Workmanship Warranty: 3 years interior, 2 years exterior, 1 year deck/fence. Full terms, coverage, exclusions, and the claims process are posted at westchasepainting.com/warranty. Our liability under the warranty is capped at the original contract price of the affected project. The warranty is in lieu of all implied warranties to the fullest extent permitted by Florida law.
Refunds
Because our services are custom and labor-based, refunds after work is completed are handled case-by-case under the warranty process (see warranty). Deposit refunds are governed by the cancellation policy above. If you have a concern with completed work, please notify us in writing within 30 days so we can inspect and remedy.
Photography and Marketing
We may photograph completed projects and use non-identifying images (exterior elevations, interior rooms without personal details) for our portfolio, website, and marketing materials. If you prefer your project not be photographed, let us know before work begins and we will respect that.
Intellectual Property
All content on westchasepainting.com, including text, images, logos, and the overall design, is the property of Westchase Painting Company LLC or used with permission. You may not reproduce, redistribute, or use our content commercially without written permission.
Limitation of Liability
To the fullest extent permitted by Florida law, Westchase Painting's liability for any claim arising from its services is limited to the total contract price paid by you for the project in question. We are not liable for indirect, consequential, special, or punitive damages, including lost profits or loss of use.
Dispute Resolution
Any dispute will be governed by the laws of the State of Florida. Before filing any legal action, the parties agree to attempt to resolve the dispute in good faith, including the pre-suit notice procedures of Chapter 558, Florida Statutes, when applicable. Venue for any action shall be in Hillsborough County, Florida.
Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
